JOB OVERVIEW:

The Employment Law Associate / Senior Associate Counsel (leveling with depend on candidate’s qualifications) will manage employment litigation across the Company, including employment mediations and arbitrations, and management of outside counsel. The Associate Counsel will provide strategic, proactive legal advice and counsel through interactions with operations management and human resources teams.


Reports to: SVP – Division General Counsel Direct Reports: 1-2


ROLES & RESPONSIBILITIES:

-Advise restaurant managers and enterprise professionals in all areas of employment law, including recruiting, hiring, discipline, terminations, wage and hour, and harassment in order to reduce legal risks from employment practices

-Conduct internal investigations in response to employee or guest complaints

-Prepare responses to government claims and charges

-Represent the company at mediations, agency hearings, arbitrations, and trials

-Act as liaison between outside counsel and all company representatives and witnesses, including overseeing litigation discovery protocols

-Prepare, review, and negotiate outside counsel contracts, requests for proposals, and other legal documents related to outside legal partners

-Manage and resolve cases within set budgets and parameters

-Support the development and implementation of personnel policies and procedures, keeping abreast of all pertinent federal, state, and local laws and communicating changes and trends in those laws to company personnel

-Support the drafting of employment agreements and severance packages

-Interact with company senior leaders and outside counsel on complex issues having impact or potential impact across the organization

-Perform in an advisory role on complex legal projects with other law department attorneys

-Develop team members by supporting training, development, and other professional growth opportunities

-Manage individual and team performance through coaching, feedback, and performance management discussions


REQUIRED TECHNICAL SKILLS:

-3+ years (for Associate Counsel) or 7+ years (for Senior Associate Counsel) of experience in litigation and employment law at a public company, consulting firm, or law firm required - in-house experience is preferred

-Excellent project management, writing, research, communication, and problem solving skills is required


REQUIRED EDUCATION:

-A Juris Doctorate from an ABA accredited law school is required

-Must be licensed to practice law and in good standing under the Bar of any state that enables admission to practice as in-house counsel in Florida


OTHER KEY QUALIFICATIONS:

-Must have proven team orientation skills working on a multidisciplinary team in a fast-paced, dynamic environment

-Must have strong initiative and ability to handle multiple large scale projects/roles requiring the collaboration of multiple functional groups

-Bilingual (English/Spanish) is a plus

-Must have the ability to adapt to changing priorities, work in a matrix environment, and lead and influence cross-functional teams


PREFERRED SKILLS & EXPERIENCE:

-First or second chair trial experience is preferred

-Experience in negotiating settlements and serving as a representative in mediations/arbitrations is preferred

-Strong knowledge of California employment law is preferred

-Experience with large scale, class/collective actions is preferred
